These Terms govern your use of the High Country Adaptive Sports website, portals, and online services (the “Site”). By using the Site, you agree to these Terms.

1. Eligibility and accounts

• You must be at least 13 to use the Site; program participation for minors requires parent/guardian consent.
• Keep your login credentials confidential and notify us of unauthorized use.

2. Acceptable use

Do not:

• Interfere with the Site or attempt to access accounts or systems without authorization.
• Post unlawful, infringing, harassing, or confidential information about others.
• Use the Site for commercial solicitation without written permission.

3. Program participation and safety

• Activities carry inherent risks. Follow all instructions, policies, and safety guidance from HCAS staff/volunteers.
• You are responsible for ensuring participation is appropriate for your health and abilities; consult a clinician as needed.
• Media consent, waivers, and participant forms are required before activities.

4. Donations, memberships, and merchandise

• Donations/Memberships: generally non-refundable to the extent permitted by law; receipts provided for your records.
• Merchandise: purchases are subject to posted pricing, taxes, shipping, and availability. Set your return/exchange window to [30] days for unworn/unused items with proof of purchase (update here to match your policy).
• Event tickets: refunds or transfers follow event-specific policies; weather or safety changes may require rescheduling.

5. Donor recognition

• Unless you opt out, we may recognize your gift by name and level. Tell us if you wish to remain anonymous or prefer a different listing.

6. Intellectual property

• The Site and its content are owned by HCAS or licensed to us. You may not copy, modify, distribute, or create derivative works without permission.
• If you submit testimonials, photos, or stories, you grant HCAS a nonexclusive, royalty-free license to use, edit for length/clarity, reproduce, and display them for mission purposes, subject to your media consent settings.

7. Privacy

• Our Privacy Policy describes how we collect and use information. By using the Site, you agree to the Privacy Policy.

• Text Messaging Terms: By opting in to SMS communications from High Country Adaptive Sports, you agree to receive text messages related to program participation, scheduling, reminders, event coordination, and responses to inquiries. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. 8. Third-party services and links

• We may link to third-party sites or use processors for payments, registration, analytics, and ecommerce. We are not responsible for their content or practices.

9. Disclaimers

• The Site is provided “as is.” We disclaim warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee uninterrupted or error-free operation, or that defects will be corrected.

10. Limitation of liability

• To the fullest extent permitted by law, HCAS and its directors, officers, employees, and volunteers are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or data, arising from your use of the Site or participation in activities.
• In jurisdictions that do not allow such limitations, liability is limited to the maximum extent permitted by law.

11. Indemnification

• You agree to indemnify and hold HCAS harmless from claims arising out of your breach of these Terms or misuse of the Site.

12. Changes to the Terms

• We may update these Terms at any time. Continued use of the Site after changes means you accept the updated Terms.

13. Governing law and venue
